On Sunday April 15, over 250 residents gathered in front of city hall to spread the word and show their concerns for the FORCED installation of radiation emitting smart meters on homes and businesses.

Among the concerns are privacy, security, health, and the heavy handed approach the city is taking.

"The Constitution is not an instrument for the government to contain the people. It is an instrument for the people to contain the government.", stated Dave Bendis, Naperville resident and rally speaker who addressed the crowd regarding the constitutional violations of mandated smart meters.

Most attendees were opposed to the installation, while a few were just hearing about it for the first time and wanted more information.

"We just don't understand why the city is so unwilling to allow residents to choose. Its our home, our personal property.  We pay the mortgage, pay for the upgrades on our property, pay the taxes. It just doesn't make sense and it makes me think there is something more going on than the city is revealing." stated one resident who asked not to be identified.

Sentiments from the rally have ranged from gratefulness and empowerment to outrage and disgust towards the actions of the city and utility. Attendees have expressed they left the rally feeling empowered and moved to action.

Federal Lawsuit Status Update
On April 19, Judge Chang began proceedings to rule on the motion for injunction to halt the forced installation of smart meters on Naperville residents until reasonable options are afforded them.

The outcome of the preliminary hearing was as  expected. Despite the city's attempt to spin this as a victory, the judge adhered to the rules of proceedings. The hearing was a briefing schedule and nothing more.

The next hearing is scheduled for May 31, 2012.

More that you can do
Many residents do not want a smart meter installed on their home.  They want the choice and according to the U.S. Constitution and the Energy Policy Act of 2005, we have that right. The city has denied its residents the choice.

According to the city you will have opportunities to refuse the wireless smart meter, but you must sign up for the non-wireless alternative and pay the monthly penalty fee to protect your home and family. If after the 3rd attempt to install a meter on your home, and you have not signed up for the alternative, the city says it will bring a police escort to your home to intimidate you into allowing the installation of the wireless smart meter.

We feel this is outrageous. There must be something serious wrongly with smart meters if the city has to threaten you to install one.

Federal Injunction Status
Today, April 19, Judge Chang began proceedings to rule on the motion for injunction to halt the forced installation of smart meters on Naperville residents until reasonable options are afforded them.

The outcome of today's preliminary hearing was as  expected. Despite the city's attempt to spin this as a victory, the judge adhered to the rules of proceedings. Today's hearing was a briefing schedule and nothing more. Click here to view court document.

Judge Chang clearly sees enough merit in this case to ensure the proceedings are followed correctly.  If this case had no merit, the judge would've dismissed it today.

As a result of the city forcing smart meters on their homes against their will, five more residents have joined the suit. Since the case has not been dismissed, each party will be given the opportunity to respond and oral arguments will begin on May 31.

"As reported in the Naperville Sun, UPA Customer Representative Jeff King said that it was his company's policy to not engage in any debate with a customer and if any UPA employees were arguing with customers, they were violating company policy.

"There is a set process for customers who deny it (the smart meter)," he said. "We verify the customer's name, address and phone number and turn it in to the city of Naperville. We won't argue with them ... there is no reason at all to get in any conflict with a customer." "
