Naperville Smart Meter Lawsuit Provides Model for Victory in Hawaii Federal Court
On 4/25/2012, Hawaii's Federal Court upheld a motion for injunction that prevents Kauai Island Utility Cooperative (KIUC) from installing a smart meter on the plaintiff, Adam Asquith's home.

Asquith submitted a motion for preliminary injunction on 3/16/2012 that was modeled after the Naperville Smart Meter Awareness group request for federal injunction. KUIC requested a motion to dismiss but withdrew that request on 4/16/2012.

This represents a huge win for Hawaii residents and sets precedence for court systems across the United States. Resident's across the country are stepping up and fighting for their legal right to protect their property, to refuse a smart meter, and to refuse the right to pay to keep their analog meters.

This Federal Court ruling comes at the same time that the largest utilities in California (SDG&E and PG&E) are also being required to provide customers with the right to retain their analog meters.

Additionally, VT residents are being offered a free opt out option: VT Opt Out Option

Illinois residents need to take action now! 

ComEd has submitted their Smart Grid Plan to the ICC, but it is not without confusion.  Public comment on this very important project is crucial.

Federal Lawsuit Status Update
On April 19, Judge Chang began proceedings to rule on the motion for injunction to halt the forced installation of smart meters on Naperville residents until reasonable options are afforded them.

The outcome of the preliminary hearing was as  expected. Despite the city's attempt to spin this as a victory, the judge adhered to the rules of proceedings. The hearing was a briefing schedule and nothing more.

The next hearing is scheduled for May 31, 2012.

This is a utility policy that is being marketed as a mandated project. It is an opt in program.

More that you can do
Many residents do not want a smart meter installed on their home.  They want the choice and according to the U.S. Constitution and the Energy Policy Act of 2005, we have that right. The city has denied its residents the choice.

According to the city you will have opportunities to refuse the wireless smart meter, but you must sign up for the non-wireless alternative and pay the monthly penalty fee to protect your home and family. If after the 3rd attempt to install a meter on your home, and you have not signed up for the alternative, the city says it will bring a police escort to your home to intimidate you into allowing the installation of the wireless smart meter.

We feel this is outrageous. There must be something serious wrongly with smart meters if the city has to threaten you to install one.

Tell them Naperville is not a "police state" and residents won't accept being threatened or forced to install a meter on their home that they do not want.

Smart meters are currently being installed in Naperville despite a complaint for federal injunction and on-going investigations by the Illinois Attorney General for Open Meetings Act violations by the City of Naperville in conjunction with this project.

Smart meters pose risks in the areas of privacy, costs, security, and health and are not a federally mandated program. Our mission is to educate the residents of Naperville by bringing all pertinent information to the public and in doing so, advocate for a smarter solution in Naperville.
