Join NSMA on May 31, 2012, at 9:30 am, in Courtroom 1403 (Judge Chang), Everett McKinley Dirksen United States Courthouse, 219 South Dearborn Street, Chicago, IL. Federal Judge Chang will hear arguments from NSMA Attorney Doug Ibendahl and the City of Naperville's attorney.
NSMA filed a motion requesting that, as this lawsuit moves forward, home and business owners can request to opt-out and retain their analog meter until a final ruling is made by the judge. Further, the motion requests that the judge order the City to re-install an analog meter to a home or business upon request.

Smart Meter Defiance Slows Grid Upgrade, Bloomberg Reports

A growing consumer backlash against new wireless digital technology for measuring power usage is slowing U.S. utilities' $29 billion effort to upgrade their networks.
States including California, Maine and Vermont have responded to customer concerns about higher bills and safety by offering them the option of keeping their conventional devices for an extra charge.

Federal Lawsuit Status Update

On April 19, Judge Chang began proceedings to rule on the motion for injunction to halt the forced installation of smart meters on Naperville residents until reasonable options are afforded them.
The outcome of the preliminary hearing was as expected. Despite the city's attempt to spin this as a victory, the judge adhered to the rules of proceedings. The hearing was a briefing schedule and nothing more.
The next hearing is scheduled for May 31, 2012.
