Federal Hearing Postponed To Be Rescheduled Case Name:     Naperville Smart Meter Awareness v. City of Naperville  Case Number:    1:11-cv-09299  Docket Text: MINUTE entry before Honorable Edmond E. Chang: This case is on the list of randomly-selected cases to be reassigned on June 4, 2012, to one of the new district judges, who will take office on that date. Accordingly, the 05/31/12 status and motion hearings are vacated, and will be reset by the new judge. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ The May 31st hearing has been postponed.  As you can see from the text above, this a randomly assigned event. We will provide an update on June 4 when the case has been reassigned. Federal Lawsuit Status Update On April 19, Judge Chang began proceedings to rule on the motion for injunction to halt the forced installation of smart meters on Naperville residents until reasonable options are afforded them. The outcome of the preliminary hearing was as  expected. Despite the city's attempt to spin this as a victory, the judge adhered to the rules of proceedings. The hearing was a briefing schedule and nothing more. The next hearing is scheduled for May 31, 2012. They have guarded their analog meters.   They have hired electricians to de-install smart meters when utilities have refused. They are locking up their gates, posting NO TRESPASS signs and protecting their property.*            Click here for more pictures:  This is no longer about smart meters.  This is about protecting your personal property.  This is about protecting your constitutional rights. You are protected under the 4th, 5th, and 14th Amendment and the Energy Policy Act of 2005. This is a utility policy that is being marketed as a mandated project. It is an opt in program. Stand your ground!   Protect your property!   It is your home!  You have the right to protect your property from something that may harm you! Take back your power! More that you can do Many residents do not want a smart meter installed on their home.  They want the choice and according to the U.S. Constitution and the Energy Policy Act of 2005, we have that right. The city has denied its residents the choice. According to the city you will have opportunities to refuse the wireless smart meter, but you must sign up for the non-wireless alternative and pay the monthly penalty fee to protect your home and family. If after the 3rd attempt to install a meter on your home, and you have not signed up for the alternative, the city says it will bring a police escort to your home to intimidate you into allowing the installation of the wireless smart meter. We feel this is outrageous. There must be something serious wrongly with smart meters if the city has to threaten you to install one. Visit our website for more information on what you can do. Tell them Naperville is not a "police state" and residents won't accept being threatened or forced to install a meter on their home that they do not want. Sign the Petition If you have already made up your mind and don't want smart meters in our community then sign the Cease and Desist petition.   Tell the city to stop the install of  smart meters in Naperville.
