FEDERAL CASE UPDATE
Naperville citizens are seeking to hold their City officials accountable.   
 
Plaintiffs - which include Naperville Smart Meter Awareness - are seeking injunctive relief in federal court from the forced installation of smart meters on their homes.   
 
Plaintiffs are asking the court for a no-cost opt out option and the ability to retain their analog meters - the same relief residents in many other states already enjoy.
   
The City continues to deny its residents acceptable alternatives to forced smart meter installation.  
 
The judge in our case has issued an order allowing for full discovery.

The City continues to spend taxpayer dollars to fight its own residents to prevent them from having the choice to keep their analog meters.
 
We encourage all residents to re-engage the council, urging them to pass a resolution allowing for a no-cost opt out option.   
 
 The next federal court hearing on the case is scheduled for August 16, 2012.

The landmark Federal Court case of "ADAM ASQUITH vs. KAUAI ISLAND UTILITY COOPERATIVE" for injunctive relief ended in an out of court settlement when KIUC's motion to dismiss was voluntarily withdrawn on April 25, 2012.

 

The case was settled without going to trial. This was agreed upon at the first hearing on the injunction where the judge severely admonished KIUC. KIUC agreed that they did not want it to go to trial and agreed to settle with Adam on his complaint.

 

The settlement agreement was presented to the court for approval and signed by both parties on May 31, 2012. The "STIPULATION FOR DISMISSAL WITH PREJUDICE; AND ORDER", was approved and so ordered by Federal Court Judge Helen Gillmor on June 1, 2012.

 

"KIUC agrees that it will not seek to install (including but not limited to requesting from the Hawaii Public Utilities Commission ("PUC") permission or authorization to install a smart meter on premises where the electricity accounts are in Plaintiff's name), and will not voluntarily install without court order or an order or determination of the PUC, any smart meters on premises where the electricity accounts are in Plaintiff's name without Plaintiff's permission."

This is a utility policy that is being marketed as a mandated project. It is an opt in program.

More that you can do
Many residents do not want a smart meter installed on their home.  They want the choice and according to the U.S. Constitution and the Energy Policy Act of 2005, we have that right. The city has denied its residents the choice.

According to the city you will have opportunities to refuse the wireless smart meter, but you must sign up for the non-wireless alternative and pay the monthly penalty fee to protect your home and family. If after the 3rd attempt to install a meter on your home, and you have not signed up for the alternative, the city says it will bring a police escort to your home to intimidate you into allowing the installation of the wireless smart meter.

We feel this is outrageous. There must be something serious wrongly with smart meters if the city has to threaten you to install one.

Smart meters are currently being installed in Naperville despite a complaint for federal injunction and on-going investigations by the Illinois Attorney General for Open Meetings Act violations by the City of Naperville in conjunction with this project.

Smart meters pose risks in the areas of privacy, costs, security, and health and are not a federally mandated program. Our mission is to educate the residents of Naperville by bringing all pertinent information to the public and in doing so, advocate for a smarter solution in Naperville.
