Update on Jennifer & Kim + MONDAY: Take Action - PURPA hearing

NSMA Logo
Action Alert:

PURPA hearings - Attend, Write and/or Speak:
What are the hearings for?  The Council will review the Utility's recommendations for new standards, including Smart Meters.  The City failed to follow the Energy Policy Act and get residents input in 2009 before they accepted the grant from the Stimulus Bill.   More details are here.

We are submitting a significant amount of evidence supporting our objection to the City's adoption of AMI/Smart Meters as a standard.  We also plan to bring forth numerous witnesses who will testify in support of our position.
  • March 4, 2013:  3 - 7pm - First PURPA hearing - Speak during Public Comment
  • March 19, 2013:  10am - 4pm Hearings continue & conclude (no agenda yet)
    • Both Hearings held in Council Chambers at 400 S. Eagle St., Naperville

These hearings are open to the public.  You are encouraged to attend and make your statement.  You will have 10 minutes.  If you're unable to attend, watch live on TV/web (see notice for information on remote viewing).

Your Action Items:

1) Public comment is open through March 19. Write a statement and read it at one of the hearings. Your statement should indicate that you want the option to retain your analog meter without a fee, which is protected by the Energy Policy Act. Cite your reasons and sources (risks of privacy, health, security of your personal information and our electrical grid, personal property damage, control, and cost increases).

Copy us so we have a record of all statements submitted.

Update on the Legal Defenses for Jennifer and Kim:

On Jan 23, 2013, Jennifer Stahl and Kim Bendis, NSMA board members, were arrested in conjunction with the very heated debate about mandated smart meters in Naperville (video).

Both Jennifer and Kim have made their first appearance in DuPage County court. Jennifer pleaded not guilty to two ordinance violations: interfering with a police officer and preventing access to customer premises. She is due back in court March 20. Kim appeared in court Tuesday on two misdemeanor charges: attempted eavesdropping and resisting a peace officer - but has not yet entered a plea. She is due back in court April 24 for an arraignment hearing.  This video explains why the City's charges are frivolous.

Jennifer's charges, if convicted, carries a maximum fine of $500. Kim's charges carry a heavier penalty: up to 2 years in prison (1 year for each charge) and $2,000+ in fines.

The city has chosen to pass on their 1st opportunity to drop the charges they brought upon them.

Our community must keep asking:
  • If these two women are as "crazy" as the City and Council hope to portray them, why not just ignore them?
  • Or is it possible that everything they are advocating for is too threatening?
  • Why doesn't the City and Council want residents to have a choice to refuse the new meters?
Jennifer and Kim are right to defend their innocence against this flagrant misuse and abuse of power. Here's how they ask you to help:

1) Do "Your Action Items" above

2) Vote April 9th to reclaim Naperville for residents and encourage others to do the same

Jennifer and Kim submitted the following statement after the fundraiser held to support them on Sunday evening:
Jennifer Stahl & Kim Bendis Feb. 2013
"We are grateful to have received so much support from many people from all over the Chicagoland area, within the USA and beyond.  We appreciated that so many attended our gathering at Traverso's on Sunday and enjoyed the time to connect in person.  Your generosity supporting our defense in court is overwhelming.  We feel so blessed.  We encourage everyone to stand with us as we move forward with our efforts to regain our property and civil rights.  Thank you again.
-Jen and Kim"

Naperville Smart Meter Awareness is a non-profit 501(c)(4) group of concerned citizens educating the public about the risks of wireless smart meters. We are comprised of lawyers, technology professionals, health advocates, accountants, business owners and parents in our community.

Smart meters are currently being installed in Naperville despite a complaint for federal injunction and on-going investigations by the Illinois Attorney General for Open Meetings Act violations by the City of Naperville in conjunction with this project.

Smart meters pose risks in the areas of privacy, costs, security, safety and health and are not a federally mandated program. Our mission is to educate the residents of Naperville by bringing all pertinent information to the public and in doing so, advocate for a smarter solution in Naperville.
